These terms of offer and sale ("Supply Terms") apply to goods and services acquired through the website Atharva - House Of Sarees (https://houseofsarees.in), which is run by Rohan Ventures, a business registered under the Companies Act of 1956 ("Company" or "Rohan Ventures" or "We" or "Us" and its successors and assigns). Users of the website shall be referred to as ("You" or "Your" or "Yourself" or "User" or "Customers") under these Supply Terms. A user is everyone who visits the website, whether or not they intend to make a purchase.
Any part of the website or the services offered by the firm may be revised or discontinued at any point, for any reason, without providing you or any other party any notice and without incurring any kind of obligation. It is your responsibility to frequently check these Terms of Use so that you are aware of any updates. Nothing in these Terms of Use should be interpreted as giving third parties any rights to Access the website but do not make any purchases if you disagree with the supply terms.
SECTION 2 - GENERAL
Please read the terms of the offer for sale carefully before purchasing any products or availing any services on your approval of the supply terms and the agreement to be bound by them is evidenced by any purchases you make via the website. In addition to the foregoing, you are also subject to the website's terms of use, the vendor's terms, and any other additional terms of use that are presented when a product is chosen. SECTION 3 - DESCRIPTION OF SERVICE
Access to information and purchases of saris, clothing, accessories, and fashion as well as silver and gold accented jewelry are made possible through info@houseofsarees.in. Only Members may utilize some of the services offered on this website. A user who has registered on the website and given info@houseofsarees.in with their contact information is referred to as a Member.
Only end users who buy our items to use or give as gifts are eligible for the services on our website. These conditions do not apply because this is not a wholesale website.
All goods and services purchased through the website will be sent in accordance with the company's policies. The shipping guidelines may occasionally be modified by ATHARVA. Due to screen settings and photographic methods, objects displayed on the internet occasionally may look somewhat bigger or smaller than their real size. Items may occasionally be depicted either larger than they are in reality to clearly exhibit details or smaller than they are in reality to show the full object.

SECTION 4 - REGISTRATION

SECTION 5 - REGISTRATION
Any member may add a product to their basket, provide their billing and shipping information, select an allowed payment method, and finish their purchase at info@houseofsarees.in
In the event that the bank or payment processor declines to honor the transaction, info@houseofsarees.in shall have the right to decline to dispatch the customer's purchase without incurring any obligation.
Without incurring any liability, info@houseofsarees.in reserves the right to refuse to ship an order to a customer despite receipt of payment in the event that a product does not pass a quality control test, the product is not available, or for any other unspecified reason.
You acknowledge that you will give true, right, and complete credit/debit card information when using your card on/through the authorized payment gateway to use the services offered on the website. Credit/debit cards that you do not legitimately own may not be used.
Unless necessary for the purpose of verifying fraud in accordance with law, regulation, or court order, the information you supply to ATHARVA will not be used or shared with any third party. No credit card or debit card information is kept by ATHARVA offline or online. Your credit/debit card information will be kept secure and secret at all times. With regard to any potential liabilities brought on by any unlawful credit card use, ATHARVA fully disclaims any responsibility.
SECTION 6 - PRODUCT AVAILABILITY
info@houseofsarees.in may not own all of the products that are listed on the website. When this occurs, info@houseofsarees.in orders the goods specified on the website from the relevant brands and merchants after receiving the client's order confirmation and sends them to the consumer. As a result, it's possible that the customer's requested item has already been discontinued by the brand or merchant and the information was not updated with info@houseofsarees.in at the time of the order.
After an individual has already made an order and the product is sold out, iinfo@houseofsarees.in will call the buyer and advise a different product. Using the client's email confirmation, ATHARVA will proceed and verify any further purchases made by the customer. In this case, the buyer will be responsible for paying the difference in price if the new product's price is higher than the prior one. If the new product's price is less than the one the client had requested, ATHARVA will reimburse the extra money that was taken in. The customer's original method of payment will be used to process the refund. ATHARVA won't be able to issue a refund for a wire transfer from a foreign account, nevertheless. In these circumstances, the client must accept the remaining balance in the form of shop credit.
SECTION 7 - PRICING
All items offered at ATHARVA are handcrafted, and the companies, designers, and artisan weavers decide the prices.
The cost of resources, the salary of the weavers and artisans, and the complexity and level of expertise necessary to make each product determine the price of handcrafted goods. The price of a product is additionally affected by supply and demand. The prices are not guaranteed to be less expensive than those available elsewhere, and ATHARVA disclaims all responsibility for this.
The pricing details provided on the website can sometimes be shown incorrectly as a result of technical or human faults. The website https://houseofsarees.in maintains the right to fix any and all errors as they happen. In such circumstances, info@houseofsarees.in is under no obligation to honor the inaccurate and false rates. The costs shown on the website are liable to modification without prior notice. The pricing for every order is the one in effect on the day/time the order is verified. Additionally, the costs indicated on the website are not negotiable.
SECTION 8 - ADVANCE / PART PAYMENT
At its sole discretion, info@houseofsarees.in can permit a client to pay a portion of the total transaction amount as an advance when placing an order. In certain circumstances, before the goods is dispatched to the client within the company's specified time frame, the customer must pay the remaining amount (including any applicable shipping fees).
Order cancellation could happen if the remaining balance is not paid within the allotted period. The customer agrees to lose the advance paid at the time of placing the purchase in the case of such cancellation, while info@houseofsarees.in reserves the right to return the advance paid after deducting any relevant transaction or processing fees.
SECTION 9 - CUSTOMS, DUTIES AND TAXES
Recipients will be responsible to confirm that an item purchased from ATHARVA may be legally imported into the country of destination. The purchaser of a product ordered from https://www.houseofsarees.in is the "Importer of Record" and is liable for complying with all local rules and laws. Orders shipping outside of India may be subject to taxes, customs charges, and other fees charged by the country of destination.
The recipient is liable for clearing any additional fees associated with customs duties, and info@houseofsarees.in is unable to regulate or foresee the kind or amount of these taxes.
These customs fees will be billed to the recipient by the carrier or courier once they have paid them to the regional customs office on their behalf. Similarly to this, the transporter will charge the consignee (receiver) any relevant fees.
The recipient also agrees to provide any proof of address or business requested by all the parties in order to get their package processed.
Any delivery delays that may be brought on by a delay in the Customs Clearance procedure will not be the company's fault.
SECTION 10 - EXCHANGE POLICY
Before being shipped to the buyer, each product offered at ATHARVA is sourced from the finest weavers, craftsmen, designers, and brands and undergoes comprehensive quality assurance. The terms and conditions are as follows in the unlikely event that a consumer wants to swap a product, they bought from ATHARVA:
NONE OF THE FOLLOWING ITEMS ARE ELIGIBLE FOR EXCHANGE:
The product is not eligible for exchange if you chose ATHARVA's Fall Pico Service.
Products that have the blouse separated, tassels made by you, or tassels that have been hand-stitched by you are also not returnable.
Products sold by ATHARVA under its "sale section" and labelled as "SALE" are not eligible for exchange.
Blouses that have been stitched and blouse material are not returnable.
Other items, except those mentioned above, are often offered for a 7-day exchange (with certain limitations). Within 24 hours of receiving the merchandise, the client must send an email to exchange at info@houseofsarees.in informing us of their want to exchange. Exchange Requests received through phone, text message, or WhatsApp will not be considered to be exchange requests.
There will always be some variation between digital photos and real-life items, but our best efforts to guarantee that the color of the actual thing you get matches the color of the digital image on a computer screen, Due to color variations, NO EXCHANGES OR REFUNDS WILL BE AVAILABLE.
Products that are eligible for exchange must be returned in brand-new, unused, unwashed, and resalable condition with all of the original packing and labels still attached. You are only permitted to submit one exchange request for each item you buy, therefore a consumer cannot submit an exchange request for an item they get in place of an item they initially bought. Please see our Exchange Policy for information on how to exchange your merchandise.
RETURNS ARE NOT ACCEPTED BY ATHARVA. ALL WE OFFER IS EXCHANGES.
SECTION 11 - REFUNDS
The refund will be given in the way described below:
When the requested goods are not available will ATHARVA issue a refund?
Charge Card The refund amount will be sent back to the customer's credit card account by info@houseofsarees.in. Within the timeframe allowed by the bank that issued the credit card, the refund sum will be credited to the customer's account.
Cheque or Net Banking (from an Indian-based account): Within seven (7) business days after receiving the customer's refund request, info@houseofsarees.in will deposit the refund amount into the customer's bank account.
Refunds are not allowed for payments made through wire transfers, checks, or other methods from accounts located outside of India. Refunds are not available in these circumstances because they violate Indian regulations. A credit note from& info@houseofsarees.in will be issued with a value equal to the transaction's value.
SECTION 12 - SHIPPING & DELIVERY
Unless otherwise specified on the product details page, info@houseofsarees.in will send out all orders within 7 business days after receiving them.
Only the courier fees will be covered by the firm for shipment inside India. Any municipal taxes or levies, such as the octroi, will be the customer's responsibility. The recipient should thoroughly inspect the package when it is delivered.
The cost of delivery in addition to the price of the goods must be paid by the client when sending to a place outside of India. The buyer is responsible for paying any relevant tariffs and municipal taxes in the destination country.
Free or Reduced Shipping Promotions and Offers: ATHARVA occasionally runs free or reduced shipping promotions and offers for international shipment. Only orders over a set amount or orders from a certain country will be eligible for these deals. If a consumer takes advantage of such an offer and subsequently chooses to exchange a product, the free or reduced shipping offer will not apply to the replaced item.
The customer has the option to change the shipping address only if the ‘change request’ reaches info@houseofsarees.in before the product is actually shipped. To request a modification, send an email to help at info@houseofsarees.in. For standard items, this must be completed within two days after the order date. Change requests for items with the "Ready to Ship" designation must be submitted within 12 hours of the order date or time. Please keep in mind that a client can only modify their delivery address for orders coming from the same nation. There can be extra shipping fees if you wish to change the shipment nation.
The firm or courier agency must make two further tries to deliver the package if the intended recipient is not present before returning it to info@houseofsarees.in. If the client won't be present at the address where the delivery is to be submitted, all shipping and handling fees for the subsequent shipment will be charged to the customer.
The terms and conditions of the courier service are subject to the Company's guarantee for delivery. The merchandise won't be delivered if the name or address is inconsistent or incorrect.
SECTION 13 - DISCLAIMER OF WARRANTY / LIMITATION OF LIABILITY
ATHARVA makes no commitment that the goods will be suitable for any particular purpose for which the buyer may be purchasing them. Seller further disclaims all other explicit and implied warranties and conditions.
The Seller, along with its subsidiaries, affiliates, officers, directors, employees, agents, or subcontractors (collectively referred to as "Seller Affiliates"), will not be held liable in any situation to the Buyer or any other party for any special, consequential, incidental, or exemplary damages related to the goods/services or any other matter. These damages include but are not limited to lost profits, loss of goods or associated equipment, cost of capital, cost of substitute or replacement equipment, facilities, or services, downtime, Buyer's time, lost data, injury to property, or any damages or sums paid by Buyer to third parties. This limitation of liability applies whether the claim is based on contract principles, warranty, negligence, or any other tort, breach of statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise.
Under no circumstances shall the Seller or any Seller Affiliate be liable to the Buyer or any other party for loss, damage, or injury of any kind arising from or connected with these terms and conditions, exceeding the net purchase price of the goods and services actually delivered to and paid for by the Buyer.
The Seller disclaims any warranties of non-infringement with respect to the goods/services, and neither the Seller nor any Seller Affiliate has a duty to defend, indemnify, or hold harmless the Buyer from any damages or costs incurred due to patent or trademark infringement or violation of copyrights by any of the goods/services.
SECTION 14 - COLOUR DISCLAIMER
The colors of the products displayed on the computer screen may exhibit slight variations compared to the actual product. These discrepancies arise due to differences in underlying technologies of computer monitors, screen resolutions, and fabric quality. Improperly calibrated monitors can also contribute to the differences in colors. Moreover, the lighting used during the photography process plays a significant role in determining the final color appearance on the screen. It is important to acknowledge that authentic handcrafted products may exhibit irregularities in colors, prints, weaves, shapes, forms, and textures, which are inherent characteristics and not considered product defects.
SECTION 15 - FORCE MAJEURE
Seller will not be held accountable for any failure to deliver the Goods on time or in part if such failure is attributed, either wholly or partly, to actions taken by federal, provincial, or municipal authorities, statutes, ordinances, or regulations, labor strikes or other labor-related issues, fires, damages, or destruction, either partial or total, affecting the Goods or the manufacturing facility for the Goods, unavailability or inability to acquire raw materials, labor, fuel, electrical power, water, or supplies, or any other event beyond the control of the Seller, such as acts of God or unforeseeable circumstances that cause delays or hinder the production or delivery of the Goods. The Seller will assess in good faith the extent to which it can reasonably control the cause, contingency, or circumstance affecting the fulfillment of its obligations.
SECTION 16 - GOVERNING LAW
The supply terms and the relationship between you and nfo@houseofsarees.in will be governed by the laws of India, without considering conflict of law principles. Any claims, differences, or disputes arising from or related to the Terms of Offer, transactions conducted through the website, or the relationship between you and ATHARVA will be subject to the exclusive jurisdiction of the courts of Chennai. By accepting these terms, you agree to submit to the jurisdiction of such courts.
Note - ATHARVA trading under Rohan Venture
